Last week, we helped an elderly couple avoid what could have been a fatal injustice.
After fourteen years of battling an untraceable lender, they were days away from being evicted from their home — despite serious medical conditions and overwhelming evidence that the bank trying to repossess it no longer owned the mortgage.

What we uncovered explains why so many victims of financial exploitation lose hope: the truth was hidden in plain sight.


🏦 A Loan That Wasn’t Really Theirs to Enforce

In 2008, the couple’s mortgage lender — a household name in UK banking — quietly sold its loan book to a shadow company called Deva Financing PLC, a Special Purpose Vehicle (SPV) created to bundle and sell mortgages to investors.

But there was a catch.

The Deva Financing prospectus told investors something shocking:

“Deva Financing plc will not register its name on the English title deeds.
The Mortgage Business plc will lend its name for this purpose.”

In other words, the true owner of the mortgage intentionally hid behind another name.
On paper, it looked as though the original bank still owned the loan. In reality, the beneficial interest — the right to receive payments and enforce possession — belonged to the offshore investors behind Deva and its trustee, Citicorp.

This structure wasn’t accidental. It was designed to keep borrowers, courts, and regulators in the dark — allowing banks to act as if they still owned assets they had long since sold.


⚖️ A Court That Refused to Listen

Despite years of medical evidence showing the couple’s ill health — including one doctor warning that attending court “could be life-threatening” — a retired judge refused to adjourn the case.
The court ignored their data request (DSAR) still pending for crucial securitisation evidence, refused to consider medical risk, and reinstated a possession order from 2011 that had legally expired in 2017.

Then came the eviction warrant — just before Christmas.
The couple feared what so many others have already lived through: violent bailiffs, trashed homes, lost possessions, and the trauma that never leaves.


🕊️ When Compassion and Truth Intervened

That’s when Get SAFE stepped in.
We helped the couple prepare a fresh N244 application — requesting an urgent stay of execution on medical and evidential grounds.
Together, we discovered the Deva Financing prospectus clause — the one line that exposes the entire façade.

It proved the enforcing bank never had standing. The possession action was being carried out by an entity with no lawful ownership of the mortgage.

This revelation changed everything.
The couple’s case will now be properly heard in the new year, with their evidence finally on record — and most importantly, they will spend this Christmas in peace, at home.

This isn’t just one family’s story. It’s a mirror held up to the system.

  • Hidden Ownership: Securitisation routinely separates legal and beneficial title, but borrowers are never told who truly owns their debt.
  • Judicial Blindness: Lower courts often accept whatever the bank’s barrister says — even when faced with medical evidence or unsigned, unsealed orders.
  • Regulatory Apathy: Dissolved entities like Deva Financing and Bridgegate Funding continue to appear in court through nominal “successors,” unchecked.

When truth is buried under paperwork and procedure, justice dies quietly — unless someone insists on looking deeper.
