Most regulated advice concerns specific financial instruments. But planning someone’s life—educating them about options, helping them define what “enough” looks like—isn’t the same as selling a product.
Generic advice is not a regulated activity when it steers clear of specific recommendations. This leaves space for something more honest, more human: a form of planning grounded in values, not vested interests.
Crossing the Perimeter—Consciously
Still, the line between regulated and unregulated work must be respected. Generic advice becomes regulated the moment it’s used as a gateway to a sale. A disclaimer alone won’t protect you if your actions tell another story.
The key is clarity. What service are you offering? What protections apply? Are you influencing or informing?
Walking the Line: Two Hats, One Standard
Many professionals wear two hats—regulated adviser and unregulated coach. It can work—but only with structure. That means:
- Clearly defined roles
- Documented boundaries
- No cross-promotion or blurred messaging
The FCA doesn’t just regulate activities. It scrutinises intentions. Practitioners who manage both sides well do so by creating operational distance—between services, systems, and messaging.
Accountability Without Authorisation
Operating outside the perimeter doesn’t place you beyond scrutiny. It simply shifts the frame.
Your work may still fall under:
- The Advertising Standards Authority (ASA)
- The Competition and Markets Authority (CMA)
- Common law (duty of care, misrepresentation, negligence)
That’s why planners working outside regulation must hold themselves to a higher standard—because the system won’t do it for them.
Beyond Financial Capital
Perhaps the greatest opportunity outside the perimeter is the freedom to focus on what matters most: human capital.
We define total wealth as financial capital plus human capital, less liabilities. But traditional advisers ignore the biggest asset—who the client is becoming.
