In recent months, we’ve witnessed the unfolding of what is set to be the most expensive legal battle in Isle of Man history—a £270 million class action involving 1,600 claimants against Utmost International and Friends Provident International (FPI). The claimants allege serious wrongdoing, including undisclosed commissions, breaches of fiduciary duty, and unlawful means conspiracy. This case, brought by law firm Forsters and represented locally by Keystone Law, stands as a stark symbol of systemic failings in financial governance.
At its heart, the lawsuit exposes a familiar but disturbing pattern: financial institutions profiting while everyday investors are left to pick up the pieces of broken promises. Many claimants have lost substantial sums, often the product of a lifetime’s savings, and are now fighting for restitution.
A Civil Case with Criminal Overtones
Although this case is being pursued as civil litigation, the allegations—particularly around dishonest assistance and conspiracy—have a clear criminal dimension. One might expect the state to take an active role in investigating such serious matters. Yet, despite repeated efforts by Paul Birch and other claimants to engage the Isle of Man’s Attorney General’s Chambers, there has been silence on the investigative front.
The Attorney General, Walter Wannenburgh KC, has consistently declined to intervene, citing his office’s remit as strictly prosecutorial, not investigative. He has pointed claimants towards the Economic Crime Unit for any investigative action—yet no meaningful progress has emerged from that quarter.
Is This a Legal Loophole or a Failure of Public Duty?
This situation raises critical questions:
- When evidence of potential financial crime is brought forward, who ensures it is properly investigated?
- Is it acceptable for serious allegations to remain in legal limbo because of jurisdictional finger-pointing?
- What does this say about the Isle of Man’s commitment to financial integrity and consumer protection?
In a 2022 email to the head of the Economic Crime Unit, Tonio Azzopardi aptly described the authorities’ response as “wilful blindness”—an accusation that, if true, strikes at the heart of public trust.
The Bigger Picture: A System at Risk
The Isle of Man’s financial services sector has long traded on its reputation as a well-regulated offshore hub. But high-profile cases like this—coupled with a lack of decisive state action—risk damaging confidence in the island’s regulatory and legal institutions. When justice appears to be slow-walked or side-stepped, it sends a chilling message: those with power and resources can operate with impunity, while victims face an uphill battle for redress.
Why This Matters to All of Us
This isn’t just about one lawsuit or one jurisdiction. It’s part of a global struggle to hold financial actors accountable and ensure that ordinary people are not left defenceless against powerful institutions. As financial systems become more complex and cross-border, regulatory bodies must act swiftly and decisively—not hide behind procedural walls.

While doors seem closed for now within official channels, the global spotlight is turning towards this case. The resilience of claimants like Paul Birch, the legal tenacity of firms like Forsters, and the growing public awareness all play a crucial role in pushing for justice—not just in the Isle of Man, but in financial systems worldwide.
